As I write this, my friends in the Midwest and Northeast are crying about the
95 degree temperatures and 95 % humidity. The Dog Days of Summer are truly here.
I told them that those of us in the "Deep South" are already acclimated to it
since we have been experiencing it for two months. I really am sorry for those
suffering due to weather. I certainly appreciate a desk job in a cool 72 degree
air-conditioned office… especially in July… especially in Alabama.
An ability to adapt to or change our environment makes us more comfortable in
extreme heat, cold, rain or drought. That ability to adapt or change our
environment is also applicable in our professions. Some might look at economic
and financial crisis, tax legislation and spending policy (or lack thereof), and
as boulders crashing down on our chosen estate planning profession. Instead of
digging a hole, we have sought out ways to distinguish ourselves from other
practitioners. You all have seen the need to change your environment by
obtaining the AEP® designation. Now, we are going to work on getting the public
to adapt. Some of you have asked "Why so much emphasis on marketing?" Others
have asked "Where are the droves of new clients seeking out an AEP®?" And others
"Can you help me with making the AEP® designation work for me?"
To answer the first question, the impetus behind our current promotional
initiative is twofold:
- To SERVE the public with the highest caliber of estate planning
professionals that can be offered, and
- To achieve greater visibility for our AEP® designees to allow them to
SERVE the public.
These ideals come straight out of the NAEPC Mission and Vision statements,
and they are as well foundational building blocks underlying the NAEPC Code of
Ethics. Our promotional efforts for the AEP® designation are two-pronged—
public promotion and professional recruiting. First, the public promotion is
needed to educate the general public that "estate planning" is not only "estate
tax planning". Through our Estate Planning Awareness Week campaigns, the public
awareness website
www.estateplanninganswers.org, and the engagement of Brandpoint™ to write
and distribute articles focused on AEP®'s to news-seeking media outlets
(newspapers, magazines, television, radio and websites), recognition of our
professional designation and our organization's commitment to service excellence
will be brought to the forefront. By making the public aware of a website they
can visit or phone number they can call to contact one of those professional
designees, I am confident that our designees will reap the benefit.
Addressing the third question, a special session at our annual conference in
San Antonio accessible only by AEP® designees is being planned. A practice
growth speaker will be presenting pointers and resources on how to use your AEP®
designation to grow your practice. Be sure to make every effort to attend the
conference this November to reap the benefit of this special presentation.
I am proud that over 96% of our designees have renewed. We are continuing to
grow with that renewal rates and new applications.

What Everyone Should Know About the 2011 Offshore Voluntary
Compliance Initiative

On February 8, 2011, the IRS announced that it had instituted a second
offshore voluntary disclosure compliance program, the 2011 Offshore Voluntary
Disclosure Initiative (the "2011 ODVI" or the "Program"), available to all
taxpayers with previously undisclosed offshore assets. Similar to the IRS's
earlier 2009 Offshore Voluntary Disclosure Program (the "2009 OVDP"), which
closed on October 15, 2009, the new Program is intended to afford those
taxpayers—who, for whatever reason, failed to avail themselves of the 2009
OVDP—an opportunity to become compliant with U.S. tax laws. The 2011 ODVI is a
significant opportunity for taxpayers who still hold undisclosed foreign
accounts. However, taxpayers who wish to participate must follow very explicit
procedures for doing so. In addition, the costs of participating in this new
Program can be significant and are not always apparent. Therefore, it is
imperative that practitioners who are advising taxpayers with undisclosed
foreign assets become familiar with the new Program and its requirements.
