DUNCAN E. OSBORNE
Osborne, Helman, Knebel & Deleery, L.L.P.Duncan E. Osborne is a founding partner of Osborne, Helman, Knebel & Deleery,
L.L.P., a law firm in Austin, Texas. He holds an undergraduate degree from
Stanford University, a Master's degree from the University of Texas, and a JD
from the University of Texas School of Law (with honors, 1971). Mr. Osborne's
core practice is domestic and international estate planning, with an emphasis on
asset protection. With more than 40 years of experience and dedication to the
trust and estate area of law, Mr. Osborne brings an unparalleled level of depth,
creativity, and integrity to his representation of private clients. Mr. Osborne
has maintained his commitment to scholarly endeavors; he formerly served as a
member of the faculty of the University of Texas School of Law as an adjunct
professor. A frequent author and prominent lecturer on trust and estate planning
subjects, Mr. Osborne has made presentations and published articles both
domestically and internationally on onshore and offshore trusts, asset
protection, and rules governing the international regulation of lawyers and
fiduciaries.
One of the pioneers in the field of asset protection, Mr. Osborne conceived
of and was the original editor and a contributing author of the four-volume
treatise, Asset Protection: Domestic and International Law and Tactics,
published by Clark Boardman Callaghan in 1995 (updated quarterly). He was also
the founding Chair of the American Bar Association's Asset Protection Committee.
This treatise is comprehensive and entirely objective in its description and
explanation of the subject matter. It is universally considered a staple of any
asset protection practitioner's library.
Mr. Osborne is the current serving President of the American College of Trust
and Estate Counsel (ACTEC). He is a Fellow, a member of the Board of Regents, a
member of the Executive Committee, and a Former Chair of the International
Estate Planning Committee of ACTEC. Additionally, Mr. Osborne is an Academician
and a Vice-President of The International Academy of Estate and Trust Law
(IAETL). He is listed in Best Lawyers in America and Who's Who, and he is Board
Certified in Estate Planning and Probate Law by the Texas Board of Legal
Specialization.
Mr. Osborne helped develop and co-author the America Bar Association's (ABA)
first-ever official guidelines to assist lawyers in the fight against money
laundering and terrorist financing, the "Voluntary Good Practices Guidance for
Lawyers to Detect and Combat Money Laundering and Terrorist Financing." He is
former Chair of ACTEC's Financial Action Task Force (FATF) and continues to be a
member of the ABA Gatekeeper Task Force.
Mr. Osborne follows his clients and works on their behalf wherever that may
lead. Two consequences were Petitions for Writ of Certiorari in The Supreme
Court of the United States. One on tax issues challenging the retroactive
applicability of the estate tax, which was denied, and one on freedom of
religion, involving the use of a hallucinogenic sacrament, which was granted.
(Nationsbank of Texas, N.A. v. United States of America, 537 U.S. 813 (2002);
Gonzales v. O Centro Espirita Beneficente Uniao do Vegetal, 546 U.S. 418
(2006)). He also represented his client, Mrs. St. John Garwood, a key figure in
the Iran Contra Affair, where he defended her testimony before the Congressional
Select Committee and counseled her as a witness in the trial of Lt. Colonel
Oliver North. Finally, Mr. Osborne has served as an expert witness or otherwise
been retained by the United States government, foreign governments, and numerous
financial institutions to advise them on trust, estate, and tax issues.
