Message from the
Chairperson
M.
Eileen Dougherty, CTFA, CFP®, AEP®, ChFC®
Hawthorn - PNC Family Wealth
Philadelphia, PA
Welcome to the first issue of the AEP Alert for 2013! As we all take a sigh
of relief after a very hectic end to 2012, let's see what we can plan for 2013.
Your AEP® Committee continues to mirror the mission of NAEPC in providing
excellence, professionalism and supporting the team concept of estate planning.
At the start of 2013 we welcomed three new members to our AEP Committee;
Lawrence A. Schwartz, CPA, MST, AEP®, practicing certified public accountant
in Boston, MA; S. Mark Alton, CFP®, ChFC®, CLU®, CAP®, AEP®, MSFS, a
wealth advisor with the Armory Group, part of Morgan Stanley in Syracuse, NY;
and Christine S. Bell, CTFA, AEP®, Vice President and Trust Officer with
Center State Bank in Jacksonville, FL. At this time I would also like to thank
R. Mark Kirkpatrick, Esq., EPLS, AEP® of Mobile, AL for his past service to
this committee. Mark will now be working directly with the Estate Law Specialist
Board, Inc. and the Estate Planning Law Specialist designation and we
congratulate him as he makes this transition.
In November 2012, at our
49th Annual Conference, we welcomed our latest
inductees into the
NAEPC Estate Planning Hall of Fame® as
a Distinguished AEP® of the Class of 2012. Awards were presented and the acceptance
speeches were a clear indication of how moved our recipients and their families
were by this wonderful honor.
Please join me in congratulating those honored for 2012:
- Herbert Chasman, JD, CLU®, ChFC®, AEP® (Distinguished), Irvine, CA
- Colin Coombs, CLU®, CFP®, AEP® (Distinguished), Longview, WA
- Jeremiah W. Doyle IV, JD, LL.M. (taxation), LL.M. (banking law), AEP®
(Distinguished), Boston, MA
- David A. Handler, JD, AEP® (Distinguished), Chicago, IL
- Carol A. Harrington, JD, AEP® (Distinguished), Chicago, IL
- Jerome M. Hesch, JD, AEP® (Distinguished), Aventura, FL
- Christopher R. Hoyt, JD, AEP® (Distinguished), Kansas City, MO
- Louis A. Mezzullo, JD, AEP® (Distinguished), Rancho Santa Fe, CA
- Barry C. Picker, CPA/PFS, CFP®, AEP® (Distinguished), Brooklyn, NY
- Samuel H. Tannebaum, CPA/PFS, AEP® (Distinguished)
This is a fine time of the year to make travel plans, and I would strongly
suggest that you join us in Las Vegas for our
50th Annual Conference this
November 20 - 22, 2013! You'll continue to hear more about
the conference through the year and in our next AEP Alert we'll further discuss the
special AEP®-only session. This will be the third
session in the series.
I recently had a wonderful talk with a council leader from California,
looking for ways to discuss the AEP® designation with his council and how to
use the council nomination process. We know that you are all creative in your
approach to this issue and welcome your comments. As a reminder, our
tri-fold
AEP® consumer brochure is available as a printed edition or as a download from
our website. This is an excellent way to show your clients how your AEP®
designation brings value to their relationship with you as a trusted advisor.
In our committee member spotlight this month, you
will find information about three of our shining stars.
In our Technical Corner this month Paul Pantano brings us a fine article by
Edwin I. Grinberg, read more below!
Sincerely,
M.
Eileen Dougherty

Committee Members
in the Spotlight
In
the Spotlight:
Robert G. Alexander, JD, LL.M., AEP®, EPLS
Robert G. Alexander entered private practice in 1978 and concentrates in the areas of domestic and international wealth transfer, asset
protection and family business planning, including federal estate and gift
taxation, trust and estate administration, fiduciary income taxation, life
insurance planning, retirement planning, charitable planning, business
organization and succession planning and international tax planning. Bob is a
graduate of the University of Wisconsin - Madison (B.A. English, 1971), the
University of Wisconsin - Madison Law School (JD, 1976), and DePaul University
(LL.M. Taxation, 1984). In addition to serving on the NAEPC board of directors
and AEP® designation committee, Bob is a nationally-known author and speaker who
lectures and teaches extensively.
In
the Spotlight:
Robert E. Fox, CLU®, AEP®
After 20 years in a family held business, Bob became a life insurance agent
in 1968 and was "taken in" by one of the senior agents. While much was learned
from the senior agent, his advice was "don't bring the attorney in until you
have closed the case." For some reason, this advice didn't sit well with Bob and
he has always been comfortable working with attorneys to a point of providing
referrals back and forth, believing that respect shown comes back! Bob feels that his
experience is at the very heart of the philosophy of the AEP® designation. He
became a CLU® in October of 1982, an AEP® in 1994, and has attended about ten
annual conferences of NAEPC (he plans to attend the annual conference as long as
he is able and "should love to be 40 years younger.")
In
the Spotlight:
John T. Midgett, JD, AEP®
John T. Midgett is a Principal in the Law Firm of Midgett & Preti PC. His
practice is concentrated in the areas of estate planning, administration and
taxation, estate and fiduciary litigation, and family business planning. John is
a graduate of the University of Virginia, where he attained a Bachelor of Arts
degree with Distinction in 1975, and a 1978 graduate of the T. C. Williams
School of Law at the University of Richmond, where he was a member of the Law
Review. Mr. Midgett is a former instructor for the estate planning and
administration programs at Tidewater Community College and is dynamic and
nationally-known speaker on topics relating to estate planning, taxation,
probate, elder law, and family businesses. John has also written and lectured to
other attorneys, accountants, and trust officers in the related areas of estate
planning, taxation and administration for the continuing education required in
the various professions. In addition to his practice and speaking schedule, John
is actively involved in the Hampton Roads Estate Planning Council (President
2010-2011) and the Duke University Estate Planning Council. John served as Chair
of the Trusts & Estates Section of the Virginia State Bar in 2008-2009, and is a
current member of the Virginia Bar Association's Trusts & Estates Legislative
Committee. John is also a Past President of the Hampton Roads Gift Planning
Council. He is a Fellow in the American College of Trust and Estate Planning
Counsel, has been included in the 2006-2013 editions of The Best Lawyers in
America®, and was recently named the Best Lawyers' 2013 Norfolk
Litigation - Trusts & Estates "Lawyer of the Year". He has been rated as "AV" in
the areas of estate planning and administration, the highest designation
available to attorneys in the Martindale-Hubbell® Law Directory. John has been
named to Virginia Business Magazine's Legal Elite and designated as a
Super Lawyer.
